Intellectual Property

Peforever owns and operates the Site. All content, software, and the presentation of information on the Site are protected by U.S. and international copyright and trademark laws. Except as explicitly stated in this Agreement, you may not use, copy, download, display, publish, perform, distribute, modify, reverse engineer, or commercially exploit such content without Peforever's written consent. All trademarks and service marks appearing on the Site are owned by their respective owners and may not be used by you.

 

Orders/Purchases

Orders for products must be submitted according to Peforever’s online ordering procedures and must include all required information. All orders are subject to acceptance by Peforever. You will pay the prices in effect at the time you submit your order. Prices may change at any time without notice at Peforever's sole discretion, so checking the pricing at the time of your order is recommended. You are responsible for any taxes, duties, fees, or other charges imposed by government authorities on your purchases. If eligible, you may claim an exemption by providing appropriate documentation to Peforever before placing your order. In case of product shortages, Peforever will make reasonable efforts to notify you and find alternative supplies, but reserves the right to allocate products at its discretion.

 

Use Instructions and Restrictions

Products purchased from Peforever may come with instructions for proper use and installation. Some products are intended for specific uses, and Peforever sells them only for those approved applications. Ignoring these guidelines may result in personal injury, death, or property damage. You must communicate all usage instructions, warnings, and restrictions to your customers and ensure that end users comply with them.

 

Limited Warranty

Peforever warrants all products purchased by you (excluding upgrade and performance parts) against defects in material and workmanship under normal use for a period of 12 months, or according to the manufacturer’s warranty, whichever is greater. As Peforever does not manufacture any products, it cannot guarantee their performance or non-infringement of third-party rights. Peforever will transfer any manufacturers' warranties for products purchased, to the extent permitted, and will assist you in processing claims under such warranties. This warranty does not cover wear items or defects resulting from improper installation, negligence, or other factors. The warranty will be void if the product is damaged due to competitive or off-road driving. Labor costs for removal or damages due to delays or loss of use are not covered.

WHILE Peforever STRIVES TO PROVIDE ACCURATE INFORMATION, IT CANNOT GUARANTEE THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY INFORMATION AT ALL TIMES. Due to the vast inventory and changing stock conditions, Peforever is not responsible for outdated applications, warranty changes, or delays in product information. The Site may be unavailable at times and may yield unintended results. YOU ACCEPT THE SITE "AS IS" WITHOUT ANY WARRANTY. Peforever DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

 

Limitations on Liability

Peforever does not control the quality, safety, timing, or legality of products delivered by our carriers or employees. Peforever only facilitates transactions and communication. Should you have a dispute with independent buyers or sellers, you acknowledge that Peforever and its affiliates are not liable for any claims or damages related to such disputes. NEITHER Peforever NOR ANY PARTY INVOLVED WITH THE SITE WILL BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, EVEN IF Peforever WAS AWARE OF THE POSSIBILITY OF SUCH DAMAGES. Peforever'S MAXIMUM LIABILITY FOR ALL CLAIMS RELATED TO THIS SITE OR YOUR PURCHASES SHALL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCT IN QUESTION.

 

Indemnification

You agree to indemnify and hold harmless Peforever and its affiliates from any claims arising from your breach of this Agreement, violations of law, or other wrongful conduct related to marketing, selling, or using products purchased from Peforever. You will cooperate fully in the defense of any such claims, and Peforever reserves the right to manage the defense.
